Everyone’s cooperation is essential to maintaining a safe, high-quality online space.

1. Scope

This policy applies to:

• All users registered on thepreplan.com; and

It covers any content published, transmitted, or made available through thepreplan.com, in any format (text, image, video, files, links, etc.) and on any device.

2. Unlawful Content

Content is considered unlawful when it is:

• illegal under European Union law or applicable national legislation; or

• related to illegal activities, including their promotion, facilitation, or attempt.

Examples of potentially unlawful content (non-exhaustive list):

Posts containing discriminatory content based on ethnic or national origin, gender, sexual orientation, religion, disability, age, or another category protected by law.

Content intended to defraud, deceive, or mislead third parties (for example, fraudulent schemes, phishing, scams).

Infringement of copyright, trademarks, trade secrets, or other intellectual property rights.

Unauthorized disclosure of third parties’ personal data (including publication of sensitive data, doxxing, etc.).

Glorification, promotion, or facilitation of crimes (for example, violence, terrorism, sexual exploitation, or exploitation of minors).

Any other publication prohibited by applicable legislation.

3. Inappropriate Conduct or Conduct Contrary to the General Terms

Conduct is considered inappropriate when it, even if not unlawful under the law, violates our General Terms of Use or internal community rules.

Examples (non-exhaustive list):

Sending spam or unsolicited commercial communications.

Attempts at phishing or fraudulently obtaining credentials, personal data, or other sensitive information from users.

Use of offensive language, insults, threats, hate speech, or harassment directed at other members.

Publication of content that is manifestly false or misleading and likely to harm other users.

Use of the platform for purposes contrary to its intended use, or in a way that seriously disrupts other users’ experience.

Any other conduct that breaches our Terms and Conditions or supplementary policies (for example, Acceptable Use Policy, Privacy Policy).

4. How to Report Unlawful Content or Inappropriate Conduct

We provide electronic mechanisms, easy to access and use, that allow anyone to report content they consider unlawful or contrary to our General Terms.

4.1. Report Form on Each Listing

On each listing, where available, there is a “Report” button or link giving access to a specific form.

In this form, we ask the reporting party to indicate, as far as possible:

• A clear, reasoned explanation of why they consider the content to be unlawful or in breach of the General Terms;

• The exact location of the content (for example, URL, listing identification, username);

• Their name and contact email address (except in exceptional situations provided for by law);

• A good-faith statement confirming that the information provided is true and complete, to the best of their knowledge.

Where possible, supporting evidence (screenshots, links, dates, etc.) may be attached.

4.2. Contact Form or Email

Alternatively, the general contact form available at www.thepreplan.com or the email support@thepreplan.com may be used, indicating:

• The URL or other precise reference allowing the content or conduct to be located;

• The reasons why the content is considered unlawful or contrary to the General Terms;

• Any additional relevant evidence or information.

4.3. Direct Channel for Authorities

Police, judicial, and administrative authorities have a direct communication channel via the email address: support@thepreplan.com

5. Handling of Reports

After receiving a report, thepreplan.com:

Checks whether the report contains information that is sufficiently precise and substantiated to allow identification of the alleged unlawful content or conduct.

May request additional information from the reporting party, where necessary to complete the review.

Reviews the case diligently, in a non-discriminatory and non-arbitrary manner, and decides whether to:

• remove the content;

• block access to or limit the visibility of the content;

• apply measures to the user’s account (for example, warning, restriction of features, suspension, or termination);

• or take no action, where the report is not substantiated.

Once the review is complete, thepreplan.com will notify:

• The reporting party, if they provided contact details; and

• The user targeted by the report (the author of the content or account holder), of a reasoned decision, indicating, where applicable:

• The measures adopted or the decision not to act;

• The main reasons for the decision;

• The possibility of appeal through our Internal Complaint-Handling System (see point 6);

• The existence of other dispute resolution mechanisms (out-of-court and judicial – see point 7).

Reports are handled within a reasonable time and with respect for the principles of diligence, non-discrimination, and non-arbitrariness.

6. Internal Complaint-Handling System

(How to appeal decisions about content or accounts)

Anyone affected by a decision made by thepreplan.com regarding content or conduct on the platform has access to an internal complaint-handling system that is free of charge and fully electronic.

The following may file a complaint:

• The user whose content or account has been subject to a measure (removal, blocking, restriction, suspension, termination, restriction of monetization);

• The reporting party who disagrees with the decision made on their report.

6.1. Conditions and Time Limit

• An internal appeal must be submitted within six (6) months of the date on which the user was informed of the decision.

• Each decision may be the subject of only one internal appeal, without prejudice to the possibility of resorting to out-of-court mechanisms and to the courts.

• The appeal is submitted electronically, through the channels indicated in the communication of the decision (for example, a link to a specific form or a reply to the email sent by thepreplan.com).

6.2. Content of the Complaint

The complaint must be sufficiently precise and duly substantiated, including, in particular:

• Identification of the decision being contested;

• Reasons for disagreement (including, where applicable, reference to factual or interpretive errors);

• Any additional relevant evidence or information (documents, screenshots, etc.).

6.3. Review of the Complaint

thepreplan.com:

• Reviews complaints within a reasonable time, diligently, in a non-discriminatory and non-arbitrary manner;

• May reverse or amend the initial decision, where the complaint provides sufficient grounds to do so;

• Informs the complainant, with reasons, of the final decision and of the additional means of appeal available, including out-of-court mechanisms and judicial action.

Decisions under the internal complaint-handling system are made under the supervision of appropriately qualified staff, and not solely by automated means.

7. Out-of-Court and Judicial Dispute Resolution

Without prejudice to the internal complaint-handling system, users and third parties affected by decisions of thepreplan.com may resort to:

7.1. Out-of-Court Dispute Resolution (Certified Bodies)

Recipients of the service (including reporting parties and affected users) may resort to out-of-court dispute settlement bodies certified by the Digital Services Coordinators of the Member States.

thepreplan.com will indicate, in relevant decision notifications:

• The possibility of recourse to such bodies; and

• Where applicable, contact details or means of access.

7.2. Alternative Consumer Dispute Resolution Bodies (ADR)

Where applicable, recourse may also be had to certified alternative consumer dispute resolution (ADR) bodies, in accordance with consumer protection legislation.

7.3. Judicial Action

Recourse to internal or out-of-court mechanisms does not preclude recourse to the courts. Anyone affected may, at any time, bring judicial proceedings before the competent national courts, in accordance with applicable legislation.

Consumers may also file a complaint through the Electronic Complaints Book: www.livroreclamacoes.pt/entrar.

8. Protection of Personal Data

• Managing internal appeals and other means of recourse;

• Complying with legal obligations and cooperating with competent public authorities.

8.3. Retention and Rights

Personal data is retained only for the period necessary for the purposes set out above and for any additional periods required by law, in particular for evidentiary purposes and the exercise of rights in judicial or administrative proceedings.

• Access their personal data;

9. Misuse of Reporting and Appeal Mechanisms

To ensure these mechanisms function properly:

• thepreplan.com may decline to review reports or complaints that are manifestly unfounded, abusive, or repetitive;

• In cases of systematic or serious bad-faith misuse (for example, repeated false reports intended to harass), appropriate measures may be applied to the responsible user’s account, including restriction of features or suspension, in accordance with our General Terms of Use.

10. Changes to this Policy

thepreplan.com may update this policy to reflect legal, regulatory, or operational changes. When this happens, users will be informed through appropriate channels (for example, notification on the platform or by email).
